You may recall that our HOA entered into a covenant agreement with the owners of the Palms Golf Course in 2007, which was later amended in 2014 (see HOA Documents tab on the menu). While the owner of the course may sell the property to whom he/she chooses, the covenant entered by both parties, assures the HOA that the use of the property is restricted to either a golf course or other open space. The covenant runs with the land; therefore, prospective purchasers of the course are subject to its terms and conditions. To amend or terminate the covenant requires approval by vote of 75% of the homeowners.
The Board has recently been made aware of the possible interest by the County in purchasing the Palms Golf Course. In coordination with the HOA’s legal counsel, it was determined it is in the best interest of our residents to proactively pursue a seat at the table, sooner, rather than later.
Please refer to the attached correspondence from the HOA’s Land Use and Zoning legal counsel. The Board will continue to keep you informed as more information becomes available.
